Nucafey respects the intellectual property rights of others and expects users of its platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how Nucafey responds to claims of copyright infringement and how rights holders may submit a notice of infringement.
1. Notification of Claimed Infringement
If you believe that content available on or through the Nucafey platform infringes one or more of your copyrights, you may submit a written notice of claimed infringement to our designated agent. To be effective, the notification must include all of the following:
- A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the platform.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Counter-Notification Procedure
If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of a competent court for the resolution of any dispute arising from the counter-notification.
Counter-notifications should be sent to the same designated agent address listed above. Upon receipt of a valid counter-notification, we may restore the removed material unless the original complaining party files a court action seeking to restrain you from engaging in infringing activity related to the material.
3. Repeat Infringer Policy
Nucafey has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. A repeat infringer is a user who has been the subject of more than one valid DMCA takedown notice. We reserve the right to determine, at our sole discretion, whether a user qualifies as a repeat infringer and to take appropriate action, including suspension or permanent termination of their account.
4. Accommodation of Standard Technical Measures
Nucafey accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works. Such measures must be applied in a reasonable and non-discriminatory manner, must not impose substantial costs on service providers or substantial burdens on their systems or networks, and must not require gatekeeper consent.
5. Disclaimer of Liability
Nucafey acts as an intermediary platform and is not responsible for content submitted, posted, or made available by its users. The removal of allegedly infringing content in response to a DMCA notice does not constitute an admission of liability or wrongdoing on the part of Nucafey or any of its users.
Submitting a false or misleading DMCA notice or counter-notification may expose you to legal liability, including claims for damages, costs, and attorney fees. If you are uncertain whether material on our platform infringes your copyright, we recommend consulting a qualified legal professional before submitting a notice.
6. Changes to This Policy
Nucafey reserves the right to modify this DMCA Policy at any time. Changes will be effective upon posting the updated policy to our platform. Continued use of the platform following any such changes constitutes your acceptance of the revised policy.
